§ 1 Scope

and is operated by this company. Customers of the hosho GmbH can purchase products from and by hotels via the online store.

Only the following general terms and conditions apply for the business relationship between the company hosho GmbH and the customer.

These terms and conditions contain important information for customers.

We do not recognize deviating conditions of the customer, unless we have expressly agreed to these in writing.

§ 2 Conclusion of contract

The presentation of products in our online store is not a legally binding offer, but a non-binding online catalog. By clicking the button "buy" you are placing a binding order for the goods contained in the basket. The confirmation of receipt of the order follows immediately after sending the order and sets (except for the payment method "advance payment") no contract acceptance. We can accept your order by sending an order confirmation via e-mail or by delivering the goods within fourteen days. If you have chosen the payment method "advance payment", the e-mail about the receipt of your order already qualifies as a sales contract.

In the event of unavailability of the goods we reserve the right not to deliver. In this case, we will inform you immediately and refund already received compensation.

Your orders are stored with us. If you lose your documents for your orders, please contact us. We are glad to send you a free copy of your order details.

§ 3 Refunds policy upon right to cancel

If the customer exercises the right of withdrawal in accordance with § 4, costs of returning do not become due. The following "§ 4 Revocation" - the legally prescribed instruction text - informs you about conditions, exercise and consequences of the right of withdrawal for customers.

Revocation

You have the right to cancel your order without giving a reason at any time before your goods are dispatched or within 14 days after delivery, the 14 day period begins the day after you receive the goods. In case your order comprises multiple delivery shipments, the 14 day cancellation period for your ordered goods begins the day after you receive the delivery of the last shipment.

To exercise your right to cancel, you must inform us of your decision to cancel by letter, fax or e-mail using the contact details set out above. You may wish to use the model cancellation form to cancel your order, but you are not obliged to do so. If you are cancelling because of any problem with the goods, please notify us of the problem at the time of cancellation.

You will not have any right to cancel a purchase for the supply of any of the following goods:

  • the supply of goods that are made according to your specifications or are clearly personalised
  • the supply of goods which are liable to deteriorate or expire rapidly
  • in case of a contract for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if they become unsealed after delivery

To safeguard the withdrawal period it is sufficient that you send your communication concerning the exercise of the right before the expiration of the withdrawal period.


Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments we receive from you, including the costs of supply (with the exception of additional costs arising from the fact that you have chosen a different method of delivery than the offered cheapest standard method) and repay, latest within fourteen days from the date on which the notification has been received through your cancellation of the contract. For this redemption, we use the same method of payment that you used in the original transaction, unless you expressly agreed otherwise; in no case will you be charged fees because of this repayment.

Shipping costs might not be repaid.

We may refuse to repay for parcel goods until we have received the returned goods back or until you have demonstrated that you have returned the goods, whichever is the earlier.

You have to return shippable goods promptly and without exception within fourteen days from the date on which you inform us about the cancellation of this contract at hotel4home c / o VDS, Schlossstr. 5, 37412 Herzberg am Harz, Germany. The deadline is met if you send the shippable goods before the deadline of a fortnight.

You only have to pay for any diminished value of the goods when this loss of value is due to handling of the goods in a manner unnecessary to ascertain their nature, characteristics and functioning.

4.2 Voluntary Return Policy up to 60 days after receipt of goods

For all purchases in addition to the legal right we offer a voluntary right to return of 60 days, counted from the receipt date of goods. You may also use this right of return after the expiry of the 14 day cancellation period (see revocation) and withdraw from the contract by returning the goods within 60 days after receipt (period beginning on the day following receipt of the goods) to us, namely to the address mentioned concretely at the end of this paragraph. The timely dispatch is sufficient to meet the deadline. However, a prerequisite for the exercise of a voluntary right to return the item is that you have only tried out / worn the goods for fitting as carried out in a retail store, and the goods are complete, returned in their original state intact and without damage in the original sales package. The voluntary return does not exist for the sale of gift vouchers.

Repayment upon exercise of the voluntary right to return will always take place to the account you are using to pay.

Your legal right of withdrawal (see. § 4 / Terms & conditions) is subject to compliance with our rule for supplementary contractually granted (voluntary) return and remains independently consistent thereof. Until the deadline for the legal right of withdrawal, only the legal conditions that point shall apply. The by contract granted (voluntary) return policy also does not limit your statutory warranty rights which you obtain unrestrictedly.

§ 5 Delivery

Deliveries will be made to the delivery address stated in the order. Partial deliveries are not permitted. Delivery times can be found on the relevant product pages. In case of a delay in delivery we will inform you accordingly.

International shipping

hotel4home currently delivers to Germany and Austria by automation. If you live outside Germany or Austria in a EU country and are interested in our products, please contact our customer service. service@hotel4home.com. Or call: +49 5521 855358. We will be glad to find a way delivering our products to your home.

Forwarding costs abroad depend on product, country and location.

§ 7 Maturity and payment

The prices are applicable as indicated at the time of ordering. All prices include the prevailing tax. The delivery costs are shown separately for each delivery. The purchase price is due on delivery. If you fall into arrears, we are entitled by the European Central Bank to demand at the rate of 5 per cent p.a. above the announced price. If, however, a higher default damage is detectable, we are entitled to assert this. However, you will be entitled to prove that a lesser or no damage occured.

§ 8 Retention of title

The ownership of the delivered goods omits to the customer after full payment.

§ 9 Warranties

The statutory provisions for warranties apply.

We are not liable for damages which have not arisen on the delivery item itself; in particular we are not liable for lost profits or other financial losses. Insofar as our liability is excluded or limited, this also applies to the personal liability of our employees, representatives and agents. The above limitation shall not apply if the damage was caused by intent or gross negligence or a personal injury is existent. It shall also not apply when you make claims under the Product Liability Act.

In case we negligently breach a material contractual obligation, the obligation to pay damages is limited to typical damages. Statute of limitations expires in 24 months, counting from the date of delivery .

§ 10 Customer reviews, Assignments of rights

Users of the online store have the opportunity to give testimonials in written form after a purchase. When entering the customer data in accordance with § 9, the user must specify a name (nickname). The nickname is always specified as draftsman of the specified rating.

The hosho GmbH reserves the right to not display a customer review on the website or only for a limited time as well as to shorten it. Customer reviews only reflect the customer's opinion. The contents are not necessarily reflecting the hosho GmbH's opinions. The hosho GmbH is not obliged to publish user generated customer ratings. The hosho GmbH can refuse or remove the publication of individual customer ratings without giving reasons. There is no duty for the hosho GmbH to inform the user about the rejection of customer reviews.

For each user who drafted a customer review at hotel4home.com applies: The hosho GmbH is granted an exclusive license, unlimited by time and place, for the duration of the underlying legislation and and for further use of the review for any purpose online as well as offline.
